Kansas City Man Sues Commerce Bank Over Discrimination Allegations

A Kansas City man is making headlines with his bold legal move against Commerce Bank, claiming he faced discrimination while trying to open business accounts at two local branches. Michael Waller, a 64-year-old Black entrepreneur, alleges that he was unfairly treated by bank staff, leading to significant emotional distress and a hindered business opportunity.

Waller’s troubles began during a visit to the Commerce Bank branch located at 6100 Troost Avenue, as well as another at 9501 Antioch Rd. in Overland Park. His attempts to open business accounts for his new ventures—a lawn care service and a gift shop—were met with what he describes as a blatant refusal based on his race. The incidents occurred between June 20 and June 27, 2023, when Waller claims he was turned away not just once, but multiple times due to “improper documentation.” However, Waller asserts that he provided the necessary paperwork on his subsequent visit, which was still dismissed.

The Shock of Discrimination

The crux of Waller’s complaint lies in the interactions he had with branch employees. On June 27, he returned to the bank to address his previous encounters and try to open the accounts again. One employee allegedly questioned him and his fiancé about why they couldn’t use a bank closer to their home in East Kansas City before outright denying them service. Waller feels this line of questioning was a reflection of discriminatory practices at the bank.

But the situation escalated even further. As Waller attempted to leave the bank, he claims that Overland Park police were summoned without cause, leaving him feeling scared and threatened. Waller’s lawsuit describes the employee’s actions as not just retaliatory, but as a move designed to intimidate him.

Allegations and Legal Proceedings

In his lawsuit filed last month in the Jackson County court, Waller has named several individuals, including Mary “Jo” Burdett, the branch manager, and Ann Bronson, a customer advocate. According to Waller, after he presented his concerns about the apparent discrimination, staff failed to engage meaningfully or address his complaints. This disregard prompted Waller to close his personal account with the bank, further escalating his sense of injustice.

Despite the distress and delay caused by these incidents, Waller was able to open accounts at another bank without issues, demonstrating that racial discrimination still remains a pervasive concern in access to financial services.

As the wheels of justice turn, a case management conference regarding Waller’s allegations is scheduled for March 3, 2025. Commerce Bank has chosen not to comment on the specifics of the lawsuit but plans to respond through legal channels.
