Michael Seck, a local attorney, has been using a parking lot at 16th and Walnut for over a decade while visiting restaurants in the area. However, on August 1, his routine was disrupted when he discovered a **lime green envelope** on his car’s windshield labeled “parking citation.” Seck had parked there many times before without issue, creating a confusing situation for him.

Questionable Signage

According to Seck, there are **three small ‘no parking’ signs** positioned at the edge of the lot, but no clear instructions near the entrances where the **large elevated signs** indicate monthly permits are needed. Seck argued that since there wasn’t effective notification of parking regulations, the citation should be deemed unenforceable.

A Small Victory

Upon appealing the $40 fine to SP Plus, the company managing the lot, Seck was relieved to find that they agreed to drop the charge. “I pointed out to these people in my appeal that they didn’t have the legal authority to do that,” he commented, emphasizing the lack of clear signage for drivers.

Seck raised broader concerns about the enforceability of citations issued by private parking lots. He stated, “There’s no legal authority for them to do that because there’s no contract for me and the parking lot owner.” Clarifying the city’s rules about private lot management has been complicated, as local officials continue to investigate the situation.

The challenges with downtown parking aren’t just a one-off issue. Barry Tunnell, who manages Tanner Wine Bar nearby, noted, “Many of our guests are familiar with the parking situation down here.” He mentioned that others have also experienced similar citations in the area.

Seck shared that he received word from an SP Plus employee that more signs are on the way, which could help alleviate some confusion for drivers.
